General Club Rules

Revision 7.

1.    Membership of Whitby & District Model Flying Club acknowledges the elected committee’s duty and authority to manage the club’s affairs in the best interest of all its members, and is conditional upon compliance with :-

      •  All policies and procedures contained in section 5 of the club’s Constitution.
      •  All future policies and procedures as may be agreed and introduced to promote or protect the club’s activities and legal responsibilities.
      • Any and all prevailing Terms and Conditions arising from BMFA membership.
      • Any and all prevailing requirements relating to Small Unmanned Aircraft (SUA), as laid down in, but not restricted to, ‘ANO 2016 : 94D & 94F,  issued by the sport’s regulatory body, the Civil Aviation Authority (CAA).
      • Any and all formally notified conditions imposed by the estate management or local authority.

2.   W&DMFC’s official flying venue is an approximate two (2) acre site on which an annual rent is paid. This arrangement affords club members all year round flying, free from many of the constraints often imposed on more urban clubs. In order to preserve the advantages of this arrangement only “Quiet Electric” models must be flown before 09.00hrs on any day of the week. Dusk should be considered an appropriate point at which to cease the day’s airborne activities.

3.    As the site rests within an agricultural environment, retrieval of “downed” models from adjacent fields must be carried out with the greatest of care, using recognised stiles, gates and footpaths so as to avoid damage to fences/hedgerows, or distress to livestock. Where a model has come to rest in a crop field during the harvest season, the farmer has asked that members do not make any attempt to retrieve it themselves but rather notify him and he will endeavour to collect it as the crop is cut. In this situation the club Secretary must be notified immediately.

4.    Generally, whilst at the club’s flying site, or any other venue at which the club is represented, members are expected to conduct themselves in a responsible manner and refrain from such conduct as is likely to bring the club into disrepute.

5.    Members reported in breach of rules / procedures will be required to respond at committee before appropriate action is considered.

7.     Persistent or wilful breach of club rules may result in temporary or permanent suspension of membership.

8.    Safety rules may be amended at committee any time and without prior consultation when: –

      •         Advised to do so by the club’s Safety Officer.
      •         Changes are required to comply with revised BMFA guidelines or Civil Aviation Authority regulations.
      •         Changes are required to comply with local byelaws.
      •        Changes are imposed as a result of formal or legal action taken against the club.

9.     Charges for the following year’s membership and field rent will be set at the AGM and are to be paid by the end of the current year.  Apportionment of members` contributions will be as follows :-

      • Senior : 100% of membership and “field” charges.
      • Junior : 50% of membership and “field” charges.
      • Associate (new & existing) :100% (senior) 50% (junior) of the membership charges.

10.    Charges for ‘first time’ new members joining during the course of the year, and for an existing Associate member’s initial upgrade to full member status will be:-Senior : 100% of the annual membership fee (50% after end of June) and 1/12th of the “field” rate for each remaining month in the calendar year, calculated from the beginning of the month of joining.Junior : As above but set at 50% (25% after end of June) and 1/24th of the respective rates.

11.    Upgrading Associate (senior or junior) : 1/12th (Senior) or 1/24th (Junior) of the field charges for each remaining month in the calendar year, calculated from the beginning of the month of application to upgrade.

12.    Existing Senior or Junior members who, by non payment of subscriptions, allow their membership to lapse at the year-end, or elect to downgrade to Associate Member status, will not be eligible for the discounted rates shown in section 10 should they apply to either re-join or upgrade back to full membership at any time within the following 12 month period.   In such circumstances the full rates,  as detailed in section 9, apply.

13.    After a membership lapse of twelve months or more application to re-join the club will be adjudged ‘new membership’ and attract the rates as detailed in section 9.

Special Conditions

14.    Amendments to the Constitution.

      • At any formal club meeting, any full senior member may submit a proposal to amend the W&DMFC Constitution.
      • Details of the proposed amendment to be entered into the minutes of the meeting and clearly marked “FOR ATTENTION”.  The minutes will be distributed to all members by e-mail or hard copy as soon as possible after the meeting, but within seven (7) days.
      • Full discussion and formal voting on the proposal, as presented, will take place at the following month’s meeting.
      • Members who will be unavailable to attend this meeting may express their views and vote by proxy in the form of e-mail or hardcopy, either of which to be with the Secretary on the Monday prior to the meeting.
      • For the proposal to be adopted, it must be seconded by a full senior member of the club and supported by a majority vote, including proxies, on the night.
      • Any ‘tailoring’ of the proposed amendment during discussion will disqualify it from carrying on the night and must be re-presented to all members via the minutes, as above.

15.   Dissolution of Whitby and District Model Flying Club.    In the event of circumstances prevailing whereby The Club is, or will be, unable to continue to function, a resolution to dissolve the Club may be forwarded.   In such conditions the following will apply :-

      • All current members will be notified within fourteen (14) days.
      • An Extraordinary Annual General Meeting will be called to formalise the resolution.
      • The resolution will give instructions for the disposal of any assets held by, or for, The Club in order to satisfy all existing debts and liabilities.
      • Such assets as afterwards remain will not be paid or distributed among the members of The Club but rather donated to local charities, as decided on by the residual members of W&DMFC.
